These Terms of Use govern your use of the DeveloperOfWeb.com website, its content and its free tools (the "Site"). By using the Site you agree to them. If you do not agree, please do not use the Site. Paid work is governed separately by our Terms of Service and a written proposal.

Information only, not advice

Guides, articles, prices, examples and other content on the Site are general information about web development and related topics. They may not be complete or current, and they are not legal, accessibility compliance, financial, tax, medical, security or other professional advice. Laws and standards change. Before acting on anything you read here, get advice about your own situation from a qualified professional.

Prices and estimates

Price ranges, timelines and calculator results on the Site are typical figures for planning. They are not offers and do not bind either party. A price becomes binding only when it is set out in a written proposal accepted by both parties.

Free tools

Our free tools are provided for general planning, as is, and without charge:

  • Cost calculators give planning ranges based on typical projects and the options you pick. They are not quotes or offers. The only binding price is in a written proposal signed by both parties.
  • The accessibility checker is an automated scan of a single page at a single moment. Automated tools detect only some accessibility barriers and can report false positives or miss real issues. A result, including a high score or "no issues found", does not mean a website conforms to WCAG, complies with the Americans with Disabilities Act, the AODA, the Accessible Canada Act, the European Accessibility Act or any other law, and is not legal advice or certification. Only scan websites you own or have permission to test.

You use the tools and rely on their output at your own risk.

Acceptable use

You agree not to: use the Site unlawfully; attempt to gain unauthorised access to, disrupt or overload it; scan, probe or test its security; submit false, automated or abusive form entries; scrape or copy content in bulk; use our tools to scan or attack websites you do not own or have permission to test; or upload malicious code. We may block access that breaks these rules.

Intellectual property

The Site's text, design, code, graphics and logos are owned by Four Cents or its licensors and are protected by copyright and trademark law. You may view, print and share links to pages for your own non-commercial reference. Any other copying, republishing, framing or creation of derivative works needs our written permission.

Trademarks

Names of products, platforms and companies on the Site, for example WordPress, Shopify, React, Next.js and Google, belong to their owners. We use them only to describe the technologies we work with. DeveloperOfWeb.com is not affiliated with, sponsored by or endorsed by any of them.

If you believe content on the Site infringes your copyright, send a notice to info@fourcents.ca, +1 (365) 440-1786, or by mail to Four Cents, 49 Thorncliffe Park Drive, East York, Toronto, Ontario, M4H 1J6, Canada with: your contact details; a description of the work; the address of the content on the Site; a statement that you believe in good faith the use is not authorised; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for the owner; and your physical or electronic signature. We will review notices promptly and remove or disable infringing content where appropriate. Canadian notices under the Copyright Act's notice-and-notice regime are also accepted at the same address.

Links and third-party services

The Site links to websites and services we do not control. We are not responsible for their content, availability, security or privacy practices.

No warranty

THE SITE, ITS CONTENT AND ITS TOOLS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND WITHOUT ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, TO THE FULLEST EXTENT THE LAW ALLOWS.

Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, FOUR CENTS, ITS OWNERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SITE, ITS CONTENT OR ITS TOOLS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SITE IS LIMITED TO ONE HUNDRED US DOLLARS (USD $100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you; nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

Indemnity

You agree to indemnify and hold harmless Four Cents and its owners, employees and contractors from claims, losses and costs (including reasonable legal fees) arising from your misuse of the Site or its tools, your breach of these terms, or your violation of any law or third-party right.

Governing law and disputes

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. The courts of Toronto, Ontario have exclusive jurisdiction, and you consent to them, except that we may seek urgent relief in any court that has jurisdiction. If you live in the United States or elsewhere, you agree to this choice of law and forum to the extent your local law permits. Before starting a claim, you agree to contact us and try in good faith to resolve it for at least 30 days. To the extent the law allows, claims must be brought individually and not as part of a class or representative action.

General

If any part of these terms is unenforceable, the rest remains in force. Not enforcing a term is not a waiver. We may update these terms; the date at the top shows the latest version, and continued use of the Site means you accept it. These terms, our privacy policy and any signed proposal are the whole agreement about the Site.
